Terms of Use

1. Acceptance of these Terms

These Terms of Use (“Terms”) govern your access to and use of Piyaap’s mobile application and website (together, the “Service”). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. What Piyaap is

Piyaap is a services marketplace that connects people who need to hire a service (“Clients”) with independent people or businesses who offer them (“Professionals”). A Client posts a request describing the service they need; Professionals in that category get notified and can send a price and availability proposal. Piyaap only facilitates the match between both parties: it does not perform the posted services, does not employ Professionals, and does not take part in the execution of the contracted service.

3. Eligibility and accounts

You must be at least 18 years old and have the legal capacity to contract to use the Service.

• You are responsible for the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You must provide truthful, current, and complete information when you register.
• If you register as a Professional, you represent that you hold the training, permits, and licenses required under Panamanian law for the service you offer.

4. Requests and proposals

The Client controls the information posted in each request and is responsible for its accuracy. The Professional controls the content of each proposal, including the price and availability offered. Accepting a proposal creates a direct agreement between the Client and the Professional; Piyaap is not a party to that agreement and does not guarantee that a request will receive proposals, that a proposal will be accepted, or the quality, safety, or outcome of the contracted service.

5. Coins

Coins are an internal virtual currency that Professionals buy to send proposals to the requests they’re interested in. The following rules apply:

• Coins have no monetary value outside the Service and are non-refundable and non-transferable between accounts, except where required by applicable law.
• Buying coins does not guarantee that a proposal will be accepted or that a service will be arranged.
• The price and number of coins required to send a proposal may change; the current price is shown before you confirm any purchase.
• Coin purchases are processed through a third-party payment provider; Piyaap does not store your full card details.

6. Payments between Client and Professional

The price of the service is agreed on directly between the Client and the Professional, and paid directly between them, outside the Service. Piyaap does not charge a commission on the value of the service and does not process or intermediate that payment: 100% of the agreed amount belongs to the Professional. Accordingly, Piyaap is not responsible for payment disputes, invoicing, taxes, or warranties related to the service rendered between Client and Professional.

7. Verification and identity

Piyaap may request documents or information to verify a user’s identity before enabling certain features. This verification does not certify the quality, fitness, background, or professional skill of the Professional; the Client is responsible for assessing whether a Professional is a good fit for the service they need.

8. User conduct

By using the Service, you agree not to:

• Post false or misleading information, or information that infringes third-party rights.
• Harass, threaten, or discriminate against other users.
• Try to close a deal outside the Service to avoid using coins, when the request originated on the Service.
• Use the Service for illegal or unauthorized purposes.
• Interfere with the Service’s operation, including through scraping or reverse engineering.

We may suspend or remove accounts that violate these rules, at our reasonable discretion.

9. Intellectual property

The Service, its design, trademarks, and logos are owned by Piyaap and protected by intellectual property law. No rights over them are transferred to you, other than the limited license to use the Service under these Terms.

10. Disclaimer of warranties

The Service is provided “as is” and “as available”, without warranties of any kind. Piyaap does not warrant that the Service will be error-free or available at all times, nor that Professionals will meet the standards a Client expects.

11. Limitation of liability and indemnification

To the maximum extent permitted by law, Piyaap will not be liable for indirect, incidental, or consequential damages arising from use of the Service, nor for acts or omissions of Professionals or Clients, including injury to persons or property occurring during a service agreed between them. You agree to indemnify Piyaap against third-party claims arising from your breach of these Terms or from the service you provide or hire through the Service.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if necessary to protect the Service or other users.

13. Governing law

These Terms are governed by the laws of the Republic of Panama. Any dispute not resolved directly between the parties will be submitted to the competent courts of Panama, unless mandatory law in your jurisdiction provides otherwise.

14. Changes to these Terms

We may update these Terms at any time. Continued use of the Service after an update means you accept the revised Terms. We will update the date at the top of this document whenever we do.
